| II. Meşrutiyetin ilanıyla parlamentolu monarşiye geçildiğinden, Osmanlı ülkesinde yaşanan sorunların büyük ölçüde çözüme kavuşturulacağına inanılmaktaydı. Çözüm bekleyen konulardan biri de ordunun yeniden düzenlenmesi meselesidir.Ordunun karar mekanizması olan subay zümresi içerisinde terfi sisteminin liyakatten uzak olarak sadakat temeline dayanması, rütbelerde bekleme süresini ve yaş sınırını belirleyen kıstasların olmaması subayların en temel sıkıntılarıdır.Subayların yaşadıkları bir diğer ortak sıkıntı ise emeklilik problemidir. İstifa eden veya görev süresinin bitimiyle emekliye sevk edilen subayların özlük hakları ile vefatı veya şehit olması sonucunda geride kalan aile fertlerinin geçimini karşılayacak yasal düzenlemeler mevcut değildi. Ayrıca ordunun, İttihat ve Terakki Cemiyetinin iktidar hırsı sonucunda siyasete alet olması sorunların çözümünü daha da zorlaştırmaktaydı.1909 yılında bu sıkıntıları gidermek için Tahdid-i Sin, Tasfiye-i Rüteb-i Askeriye ve Askerî Tekâüd ve İstifâ Kanunları yürürlüğe kondu. Ordunun çıkarılan kanunlarla amaçlanan dinamik yapıya kavuşabilmesi için uzun bir sükûnet dönemi gerekmekteydi. Fakat ardı ardına çıkan savaşlar sebebiyle Osmanlı ordusunun düzenlenmesi için ihtiyaç duyulan yeterli zaman bulunamadı. | |||
| It was believed that the problems in the country of Ottoman would mostly be solved by means of the declaration of Constitutional Government because of the fact that the Monarchy with parliament was accepted. One of the subjects waiting for being solved was the reorganization of army.In the class of officers that is the army?s mechanism of decision, it was among the most basic problematic subjects waiting for being solved that the system of promotion was away from merit but based on loyalty and there weren?t any regulations which determined the waiting period and age limit in ranks.One of the other common problems that officers had was the problem of retirement.There weren?t any regulations related to the living conditions of the families of officers who resigned willingly or who got retired by accomplishing their military occupations and who died or fell martyr in a battle.Besides, it caused the solution to the problem more and more difficult that the army served politics with the result of desire of power of Committee of Union and Progres. These problems were tried to be solved in 1909 by establishing the laws of Age Limitation, Elimination of Military Ranks and the law of Military Resignation and Retirement. | |||
